Terms of Service

Last updated: September 22, 2026

DRAFT — placeholders in [brackets] need to be filled in and this page should be reviewed by a qualified lawyer before it goes live, particularly the liability and service-scope sections.

These Terms of Service ("Terms") govern your use of fusioneta.com.my and related subdomains (the "Site"), operated by FusionETA Sdn Bhd ("FusionETA", "we", "us", "our"), and any services described on the Site. By using the Site or engaging our services, you agree to these Terms.

1. Services

FusionETA provides software integration and development services, including but not limited to connections between platforms such as Bitrix24, Xero, and WhatsApp Business (Wazzup), custom internal tools, and related consulting. Specific scope, deliverables, and fees for any engagement are set out separately in a proposal, quote, or service agreement between FusionETA and the client.

2. Use of the Site

You agree to use the Site only for lawful purposes and not to attempt to gain unauthorized access to any part of the Site, its underlying systems, or data belonging to other users or clients.

3. Intellectual property

Unless otherwise agreed in writing, all content on the Site — including text, graphics, logos, and branding — is the property of FusionETA and may not be reproduced without permission. Custom software built for a client is governed by the terms of the relevant service agreement, not this Site.

4. Third-party platforms

Our services often integrate with third-party platforms (e.g. Xero, Bitrix24, WhatsApp Business). We are not responsible for the availability, performance, or policies of those third-party platforms, which are governed by their own terms.

5. Limitation of liability

To the fullest extent permitted by law, FusionETA shall not be liable for any indirect, incidental, or consequential damages arising from use of the Site or our services, except as expressly set out in a signed service agreement. [This section should be reviewed and tailored by a lawyer to fit the actual scope of services and risk allocation FusionETA intends.]

6. Confidentiality and data

Where we process client or personal data as part of a service, we do so in accordance with our Privacy Policy and any confidentiality terms agreed with the client.

7. Changes to these Terms

We may revise these Terms from time to time. The "Last updated" date above reflects the most recent version. Continued use of the Site after changes take effect constitutes acceptance of the revised Terms.

8. Governing law

These Terms are governed by the laws of Malaysia, without regard to conflict of law principles.
